We do not intentionally collect sensitive personal information such as race, ethnicity, religion, health or medical data, biometric data, financial account numbers, or government-issued ID numbers through our website. We do not store credit card numbers, bank account numbers, or full payment card details on our systems. We retain only the last four digits of a payment card and transaction records as necessary for bookkeeping purposes.

If you pay us through another service at your request (for example, Zelle), that transaction is also subject to the privacy policy of the service you use. If we change payment platforms, this policy will be updated accordingly.

  1. Cookies & Tracking Technologies

We use cookies and similar tracking technologies to operate and improve our website. These include:

  • Essential cookies: Required for basic website functionality
  • Analytics cookies: Used to understand how visitors interact with our site (e.g., Google Analytics)
  • Marketing/advertising cookies: Used to deliver relevant ads or measure campaign performance (e.g., Google Ads, Meta Pixel)

You can manage or disable cookies at any time through your browser settings. Please note that disabling certain cookies may affect the functionality of the website. For more information about Google Analytics and how to opt out, visit tools.google.com/dlpage/gaoptout.

  1. Do Not Track (DNT)

Our website does not currently respond to “Do Not Track” browser signals. This is due to the lack of a consistent industry standard for DNT compliance. We will revisit this position if a standard is adopted. In the meantime, you may limit tracking by adjusting your cookie preferences or using browser privacy features.

  1. Text Message (SMS/MMS) Communications

Service (Transactional) Messages: When you provide your mobile phone number in connection with requesting an estimate or scheduling services, you agree that we may send you text messages related to your service, such as appointment reminders, scheduling updates, estimates, and other communications about your project.

Marketing Messages: We send promotional or marketing text messages only with your prior express written consent — for example, by checking the SMS opt-in box on our website contact form. Consent to receive marketing texts is not a condition of purchasing any goods or services.

Opt-Out: You may opt out of text messages at any time by replying STOP to any message we send, or by notifying us through any other reasonable method (such as emailing info@thedfwhandyman.com). We will honor opt-out requests within 10 business days. After opting out by text, you will receive one final confirmation message and no further texts unless you re-enroll.

Help: Reply HELP to any text message for assistance, or contact us at info@thedfwhandyman.com.

Message Frequency: Message frequency varies based on your service activity. Standard message and data rates may apply depending on your carrier and plan. Carriers are not liable for delayed or undelivered messages.

SMS Opt-In Data Sharing: We will not share your opt-in to an SMS campaign with any third party for purposes unrelated to providing you with the services of that campaign. We may share your personal data, including your SMS opt-in or consent status, with service providers that help us deliver our messaging services — including but not limited to our messaging platform provider, telephone carriers, and other vendors who assist in the delivery of text messages — solely for the purpose of providing those services on our behalf.

Text messaging originator opt-in data and consent will not be shared with, sold to, or disclosed to any third parties for their own marketing or any other purposes. The sharing categories described in Section 8 of this policy exclude text messaging originator opt-in data and consent. You may opt out at any time by replying STOP to any message you receive.

  1. Sharing Your Information

We do not share your personal information except in the following circumstances:

  • Service providers: IT support, web hosting, analytics platforms, messaging and communications platforms, and payment processors who assist us in operating our business. These parties are contractually obligated to protect your information and use it only as directed by us.
  • Professional advisors: Attorneys, accountants, and insurance providers, under duties of confidentiality.
  • Government and legal authorities: When required by law, court order, or to protect the rights, safety, or property of our company, customers, or others.
  • Business transfer: In the event of a merger, acquisition, or sale of all or substantially all of our assets, your information may be transferred. We will notify you of any such change via email or a prominent notice on our website.

We do not share your information with unaffiliated third parties for their own marketing purposes. Notwithstanding the above, text messaging opt-in data and consent status are never shared with third parties, except with service providers solely as necessary to deliver messages on our behalf, as described in Section 7.

  1. Data Security

We take the security of your personal information seriously and implement the following safeguards:

  • Administrative controls: Staff training on data handling and access limitations
  • Technical controls: Encrypted email communications, secure website connections (HTTPS/SSL), and password-protected systems
  • Physical controls: Secure storage of paper records and restricted access to business systems

Data Breach Notification: In the event of a data breach that compromises your personal information, we will notify you as required under the Texas Identity Theft Enforcement and Protection Act (Texas Business & Commerce Code §521.053). Notification will be made promptly — no later than 60 days after discovery of the breach — via email or written notice, and we will report to the Texas Attorney General’s office as required by law.

While we take reasonable precautions to protect your information, no method of electronic transmission or storage is 100% secure. We cannot guarantee absolute security.

  1. Data Retention

We retain your personal information only as long as necessary for the following purposes:

  • Active service relationships: For the duration of your engagement with us and for a reasonable period thereafter
  • Business recordkeeping: Generally up to 3 years after the last service interaction
  • Tax and financial records: Up to 7 years, in accordance with IRS guidelines and Texas state law
  • Hiring records: As required by applicable employment laws, generally at least one year after the hiring decision
  • Legal obligations: As required by applicable law, regulation, or court order

When information is no longer needed, we securely delete or destroy it. You may also request deletion of your data subject to the limitations described in Section 12.

  1. Marketing Communications & Your Opt-Out Rights

We may send you marketing emails or texts about our services, seasonal promotions, or tips for home maintenance only if you have provided consent or, for email, we have an existing service relationship with you. Marketing text messages always require your prior express written consent (see Section 7).

To opt out of email marketing: Click the “Unsubscribe” link at the bottom of any marketing email, or email us at info@thedfwhandyman.com with “Unsubscribe” in the subject line.

To opt out of text marketing: Reply STOP to any text message, or notify us through any other reasonable method.

We will honor opt-out requests within 10 business days. Note that opting out of marketing communications does not affect transactional messages related to active services or appointments.

  1. Your Privacy Rights

Regardless of your location, you have the following rights with respect to your personal information:

  • Access: Request a copy of the personal information we hold about you
  • Correction: Request that we correct inaccurate or incomplete information
  • Deletion: Request that we delete your personal information, subject to legal retention requirements
  • Restriction: Request that we limit how we use your information
  • Portability: Request your data in a commonly used, machine-readable format
  • Objection: Object to the processing of your data for marketing purposes

To exercise any of these rights, contact us at info@thedfwhandyman.com with the subject line “Privacy Rights Request.” We will respond within 45 days of receipt. We may need to verify your identity before fulfilling a request. We will not discriminate against you for exercising your privacy rights.

California Residents: If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information is sold or disclosed, and the right to opt out of the “sale” of your personal information. We do not sell personal information as defined under the CCPA. For California-specific inquiries, contact us at info@thedfwhandyman.com.

  1. Children’s Privacy

Our website and services are intended for adults aged 18 and older. We do not knowingly collect, use, or disclose personal information from individuals under the age of 18. If you believe that a minor has submitted personal information to us without parental consent, please contact us immediately at info@thedfwhandyman.com. We will take prompt steps to delete such information from our records.

  1. Third-Party Links & Social Media

Our website may contain links to third-party websites, including social media platforms (Facebook, Instagram, Nextdoor, Google, Yelp, etc.). We are not responsible for the privacy practices or content of those third-party sites. Clicking a third-party link will take you away from our website and subject you to that party’s privacy policy. We encourage you to review the privacy policies of any third-party site you visit.

If you interact with us through social media (e.g., sending a message via Facebook Messenger or Instagram DMs), those communications are also subject to the respective platform’s privacy policy and terms of service.

  1. Governing Law & Jurisdiction

This Privacy Policy is governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or relating to this Privacy Policy shall be resolved exclusively in the state or federal courts located in Dallas County, Texas.

We comply with applicable Texas privacy laws, including the Texas Identity Theft Enforcement and Protection Act (Texas Business & Commerce Code Chapter 521) and the Texas Data Privacy and Security Act (TDPSA), where applicable.

  1. Limitation of Liability

To the maximum extent permitted by applicable law, The DFW Man, LLC d/b/a The DFW Handyman shall not be liable for any indirect, incidental, consequential, or punitive damages arising from a data breach, unauthorized access, or third-party misuse of your personal information, provided that we have implemented reasonable security safeguards consistent with industry standards and this Privacy Policy.

Our total liability for any privacy-related claim shall not exceed the total amount paid by you for services in the three (3) months preceding the event giving rise to the claim.

  1. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or for other business reasons. When we make material changes, we will:

  • Post the updated policy on this page with a new Effective Date
  • Send an email notification to customers with active accounts (where feasible)
  • Display a prominent notice on our website for a reasonable period

Your continued use of our website or services after the updated policy is posted constitutes your acceptance of the revised terms. If you do not agree with the changes, you should discontinue use of our website.
